AgentPack, Inc. (“AgentPack,” “we,” “us,” or “our”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our websites at www.keum.ai or www.audiopub.ai – our cloud-based artificial intelligence platforms (collectively, the “Service”).

This Privacy Policy applies to information we collect through the Service, in email and other electronic communications between you and AgentPack, and when you interact with our advertising and applications on third-party websites and services. This Privacy Policy does not apply to information collected by third parties or through any third-party applications that may link to or be accessible from the Service.

By accessing or using our Service, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our policies and practices, do not use our Service. We may update this Privacy Policy from time to time. Your continued use of the Service after we make changes indicates your acceptance of those changes.

2. INFORMATION WE COLLECT

  • Referral information if you participate in our referral program

Professional Information:

  • Information about your use case, industry, and business needs
  • Integration preferences and third-party service connections

2.2 Information Collected Automatically

When you access and use the Service, we and our third-party service providers automatically collect certain information about your device and usage:

Usage Information:

  • Information about your interactions with the Service, including features used, actions taken, and time spent

  • Social Login Providers: If you choose to sign in using Google, Microsoft, or other third-party authentication services, we receive basic profile information such as your name, email address, and profile picture as permitted by your privacy settings on those platforms.
  • Business Partners: Information from our business partners, affiliates, and resellers who refer customers to us or integrate our Service with their offerings.
  • Analytics Providers: Aggregated demographic and interest data from analytics services like Google Analytics and Mixpanel.
  • Data Enrichment Services: Additional business information to help us better understand our customers and improve our Service.

2.4 End User Data and Customer Responsibility

Our Service is a business-to-business (B2B) platform. Our customers (your employer or organization) may use the Service to process information about their own customers, employees, or other individuals (“End Users”). In such cases:

  • We process End User data solely on behalf of and at the direction of our customers, who act as the data controllers.
  • We act as a data processor or service provider with respect to End User data.
  • Our customers are responsible for providing appropriate notices to and obtaining necessary consents from their End Users.
  • Our customers are responsible for ensuring that End Users meet any age requirements and comply with applicable laws.
  • We do not control and are not responsible for our customers’ privacy practices regarding their End Users.

If you are an End User and have questions about how your information is being handled, please contact the organization that uses our Service to interact with you. See Section 12 for information about data subject rights.

3. HOW WE USE YOUR INFORMATION

We use the information we collect for the following purposes:

3.1 Providing and Improving the Service

  • To provide, operate, maintain, and improve the Service

  • To enable you to use Service features and functionality
  • To provide customer support and respond to your inquiries

  • To protect the rights, property, and safety of AgentPack, our users, and the public

4. HOW WE SHARE YOUR INFORMATION

We do not sell your personal information. We may share your information in the following circumstances:

4.1 Service Providers and Sub-Processors

We engage third-party companies and individuals to perform functions on our behalf, including:

  • Cloud Infrastructure: Amazon Web Services (AWS), Microsoft Azure, Google Cloud Platform 
  • AI and Machine Learning: OpenAI, Anthropic, Google AI 
  • Payment Processing: Stripe 
  • Analytics: Google Analytics, Mixpanel 
  • Email Services: Email service providers for transactional and marketing emails
  • Customer Support: Support ticket and chat systems

These service providers have access to your information only to perform specific tasks on our behalf and are obligated to protect your information and not use it for other purposes. 4.2 Business Transfers

If AgentPack is involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of assets, or transition of service to another provider, your information may be transferred as part of such a transaction. We will provide notice before your information is transferred and becomes subject to a different privacy policy.

4.3 Legal Requirements and Protection

We may disclose your information if required to do so by law or if we believe in good faith that such action is necessary to:

  • Comply with legal obligations, court orders, or government requests
  • Enforce our Terms of Service or other agreements
  • Protect and defend our rights or property
  • Prevent or investigate possible wrongdoing 
  • Protect the safety of our users or the public 
  • Protect against legal liability

4.4 With Your Consent

We may share your information with third parties when we have your explicit consent to do so.

4.5 Aggregated and De-Identified Information

We may share aggregated, de-identified, or anonymized information that cannot reasonably be used to identify you. This may include usage statistics, industry benchmarks, and research findings.

5. DATA RETENTION

We retain your information for as long as necessary to provide the Service, fulfill the purposes described in this Privacy Policy, or comply with legal obligations.

Account Information and User Submissions:

  • We retain your account information and User Submissions for as long as your account is active or as needed to provide you with the Service.
  • Following account closure or termination, we will delete or anonymize your information within 30 days, except where we are required to retain it for legal, regulatory, or legitimate business purposes.
  • Data stored in backups is deleted in accordance with our backup retention policy, typically within 180 days.

Usage and Log Data:

  • We retain usage data and system logs for up to 24 months for security, fraud prevention, and service improvement purposes.

Aggregated and Anonymized Data:

  • We may retain aggregated and anonymized data indefinitely for analytics, research, and benchmarking purposes.

Marketing Information:

  • If you opt out of marketing communications, we will retain minimal information to honor your opt-out preference.

Legal Holds:

  • We may retain information for longer periods when required by law, regulation, legal process, or when necessary to protect our legal rights.
6. DATA SECURITY

We implement appropriate technical and organizational measures to protect your information against unauthorized access, alteration, disclosure, or destruction. Our security measures include:

  • Encryption of data in transit using TLS/SSL protocols
  • Encryption of sensitive data at rest
  • Regular security assessments and penetration testing
  • Access controls and authentication mechanisms
  • Employee training on data protection and security
  • Incident response and breach notification procedures
  • Regular backups and disaster recovery planning

However, no security measures are perfect or impenetrable. We cannot guarantee the absolute security of your information. Any transmission of information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Service.

In the event of a data breach that affects your personal information, we will notify you without unreasonable delay and no later than 72 hours after becoming aware of the breach, as required by applicable law. We will provide information about the nature of the breach, the data affected, and the steps we are taking to address it.

7. YOUR RIGHTS AND CHOICES

7.1 Access and Portability

You have the right to access and obtain a copy of your personal information. You may request a copy of your data in a structured, commonly used, and machine-readable format (CSV) by contacting us at privacy@agentpack.ai. We will fulfill your request within 30 days.

7.2 Correction and Update

You may update or correct your account information at any time by logging into your account settings or by contacting us at support@agentpack.ai. We will make reasonable efforts to update our records promptly.

7.3 Deletion

You may request deletion of your personal information by contacting us at privacy@agentpack.ai. We will delete your information within 30 days of your request, except where we are required to retain it for legal, regulatory, or legitimate business purposes. Please note that:

  • Deletion of your account will result in loss of access to the Service
  • Some information may remain in backups for up to 90 days
  • We may retain aggregated or anonymized data that cannot identify you
  • We may retain information as required by law or to protect our legal rights

7.4 Opt-Out of Marketing Communications

You may opt out of receiving marketing and promotional emails from us by:

  • Clicking the “unsubscribe” link in any marketing email
  • Updating your email preferences in your account settings
  • Contacting us at marketing@agentpack.ai

Please note that even if you opt out of marketing communications, we will still send you transactional and service-related messages, such as security alerts, billing notifications, and account updates.

7.5 Cookie Preferences

You can manage your cookie preferences through your browser settings. See Section 8 for more information about cookies and how to control them.

7.6 Do Not Track

Some web browsers have a “Do Not Track” (DNT) feature that signals to websites that you do not want to be tracked. Our Service does not currently respond to DNT signals.

7.7 Objection and Restriction

You have the right to object to certain processing of your personal information and to request restriction of processing in certain circumstances. Contact us at privacy@agentpack.ai to exercise these rights.

7.8 Withdrawal of Consent

Where we rely on your consent to process your personal information, you have the right to withdraw that consent at any time. This will not affect the lawfulness of processing based on consent before its withdrawal.

We use cookies, web beacons, pixels, and similar technologies to collect information about your use of the Service and to provide, improve, and personalize your experience.

AgentPack is based in the United States. Our servers and data centers are located in the United States. If you access or use the Service from outside the United States, your information will be transferred to, stored, and processed in the United States.

The United States may have data protection laws that differ from those in your country. By using the Service, you consent to the transfer of your information to the United States and other countries where we or our service providers operate.

For users in the European Economic Area (EEA), United Kingdom, or

Switzerland:

  • We rely on Standard Contractual Clauses approved by the European Commission for data transfers from the EEA to the United States.
  • Our Data Processing Agreement includes appropriate safeguards for international data transfers.
  • We implement appropriate technical and organizational measures to protect your data.

10. CHILDREN’S PRIVACY

Our Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from anyone under 18 years of age. If you are under 18, do not use the Service or provide any information to us.

If we learn that we have collected personal information from a person under 18 without verification of parental consent, we will delete that information as quickly as possible. If you believe we might have information from or about a person under 18, please contact us at privacy@agentpack.ai.

Important Note for Our Customers:

Our customers are responsible for ensuring that their End Users meet applicable age requirements. If you use our Service to interact with End Users, you must:

  • Comply with applicable laws regarding children’s privacy, including COPPA (Children’s Online Privacy Protection Act) in the United States and GDPR requirements in the EU
  • Obtain appropriate parental consent if you collect information from children
  • Implement age verification mechanisms as required by law
  • Provide appropriate privacy notices to parents and children

We do not authorize the processing of children’s personal information through our Service without proper legal basis and parental consent. Our customers bear sole responsibility for compliance with children’s privacy laws.

11.1 California Privacy Rights (CCPA/CPRA)

  • We may share information with third parties for targeted advertising purposes, which may be considered a “sale” under CCPA

Right to Limit Use of Sensitive Personal Information:

  • You have the right to limit the use and disclosure of sensitive personal information to what is necessary to provide the Service

Right to Non-Discrimination:

  • You have the right not to receive discriminatory treatment for exercising your privacy rights

  • Right to delete your personal information

11.3 Nevada Privacy Rights

Nevada residents have the right to opt out of the sale of certain covered information. We do not currently sell covered information as defined under Nevada law. If our practices change, we will update this Privacy Policy and provide Nevada residents with the ability to opt out.

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have certain rights under the General Data Protection Regulation (GDPR):
